GENERAL TERMS AND CONDITIONS
These general terms and conditions of sale apply to all purchase made on the website www.bodypack.fr.
Bodypack is an e-commerce company owned by MML, with a capital of 250,000 euros, specialized in the sale of bags, a simplified joint-stock company with its head-office located at ZA Ronze, 300 rue des Carrières, 694000 TALUYERS, registered in the Lyon Trade and Companies Register under the number 959 503 160 (Intra-Community VAT identification number FR57959503160).
The customer declares to have read and accepted the general conditions of sale prior to the placing of his order. The validation of the order is worth acceptance of the general conditions of sale.
The version of the GTC applicable to a given order may be retained by the Customer by computer registration or printed on paper
Article 1 - Principles
These terms and conditions are intended to define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the buyer, from the website www.bodypack.fr
The following information is provided to the buyer in a clear and understandable manner :
The main characteristics of the product,
The price of the product,
If applicable, any additional costs of transportation, delivery or postage and any other eligible costs,
If the contact is not carried on immediately, the date or the period in which the seller undertakes to deliver the product, whatever its price,
Information about the identity of the seller, their address, phone number and email address; and their activities, those related to legal warranties, the functionalities of digital content and, when appropriate, its interoperability, the existence and implementation of warranties and other contractual conditions.
Article 2 : Content of the website
The general structure, the texts, the images, the animations, the videos and the sounds of the website belong to the company Bodypack. Any attempt at total or partial representation of the site and its contents without the express prior consent of the company Bodypack is strictly prohibited under penalty of breaking the Code of Intellectual Property which sanctions infringements.
Article 3 - The order
3.1 Orders are made exclusively on the website. The costs of the Internet access is the responsibility of the customer. The buyer has the opportunity to place their order online, from the online catalog and using the form therein, for any product, within the limits of available stocks. The buyer will be informed of any unavailability of the product or property ordered.
The sale will be considered final after the sending to the buyer of the order confirmation by email, and after receipt by the seller of the full price.
Therefore the seller agrees to provide the buyer with an order confirmation by email to the address provided by the buyer.
Any order implies acceptance of the prices and the description of the products available for sale. In some cases, including payment default, wrong address or other problem on the account of the buyer, the seller reserves the right to block the order of the buyer until the problem is solved.

3.2 Prices are in euros. They do not take into account possible additional delivery costs, which will be indicated if necessary before the validation of the order. The prices take into account the VAT applicable on the day of the order and any change of the applicable VAT rate will be automatically reflected on the price of the online shop.
If one or more taxes or contributions, including environmental, were to be created or changed, this change can be reflected in the selling price of products.
The products remain the property of MML until full payment of the price.
3.3 This is an order with payment obligation, which means that the placing of the order involves a payment from the buyer. To pay for his order, the buyer has, at his choice, the following payment methods: credit cards (VISA, MASTERCARD, other credit cards) or paypal. The buyer guaranteedO to the seller that they have the required authorizations to use the method of payment chosen during the validation of the order.
The seller reserves the right to suspend any order management and any delivery in case of denied authorization of payment, as well as the right to refuse to make a delivery or to honor an order coming from a buyer who did not fully or partially settled a previous order or with who a payment dispute is already going.
Article 4 - Delivery
4.1 Shipping costs are free when the sum of products in the basket is equal to or greater than 50 € including taxes.
If the basket does not reach the 50 € (including taxes) of products, then a participation in the delivery costs is required as follow :
* 6.90 € (including taxes) if the customer chooses a delivery in Colissimo relay point.
* 9.90 € (including taxes) if the customer chooses a Colissimo delivery at home.
Delivery times indicated are in working days. Unless otherwise stated on the website, deliveries of products only occur in metropolitan France. No delivery will be made to hotels or PO boxes.
In case of delay in the delivery, an email will be sent to the customer and a new date will be proposed. If the delivery delay should exceed 7 days for causes other than force majeure, the customer will benefit from the possibility of canceling his order by sending a registered letter with acknowledgment of receipt to the customer service of MML, to the address from its registered office within 60 working days from the originally scheduled delivery date. The sums paid by the customer under the order will be refunded. If the product has been received after the date of receipt of the cancellation by MML, the cost of return will remain the responsibility of the customer, and the return of the products will be accepted only subject to a perfect condition of products, in their original packaging.
Any reservation on the condition of the products (eg opened or damaged package) must be notified immediately at the time of delivery.
4.2 The buyer must express to the seller on the day of the delivery or at the latest one working day after the delivery, any claim of error of delivery and / or nonconformity of the products in kind or in quality compared to the indications extras on the order form. The photos are given as an indication. The customer is invited to refer to the description of each product to know the specific characteristics. In case of doubt, or for further information, it is possible to contact the customer service: firstname.lastname@example.org.
MML commits to refund the customer or to exchange any apparently defective, damaged or damaged products that do not correspond to the order.
In this case, the customer must report in writing the situation in detail and return the product (s).
Return costs will be reimbursed upon presentation of receipts.
In any case, the customer benefits from the legal guaranteedO of conformity and the latent defects, in accordance with the legal provisions in force (articles L211-4, L211-5 and L211-12 of the Code of the Consumption and articles 1641 and 1648, first paragraph, of the Civil Code).
Article 5 - Right of withdrawal
The contract formed by the acceptance of these GTC is subject to the French law. The original language of this contract is French. In case of dispute, the courts of Lyon will be competent.
In accordance with the provisions of the Consumer Code, the buyer has a period of 14 days from the date of delivery of his order, to return any item that does not suit them and request the exchange or refund without penalty, with the exception of the return costs which remain the responsibility of the buyer.
Returns are to be made in their original condition and complete, allowing their remarketing in new condition, accompanied by the invoice. Damaged, soiled or incomplete products will not be taken back.
Article 6 - Information Technology and Liberties
The information and data concerning the customer are strictly necessary for the management of the orders, the execution and the follow-up of the commercial relations, as well as for internal statistical purposes. The database thus created was the object of a declaration to the CNIL (National Commission for Data Protection and Liberties) under n ° 1637447.
This data may be passed on to companies involved in these relationships (such as those responsible for the execution of services and orders) for their management, execution, processing and payment. This data is also stored to pursue security objectives, identification of improvement and customization of services.

The customer is likely to receive offers from MML for products or services similar to those that have already been the subject of an order, or newsletters. He will be able to oppose to it at any time without charge for the future, according to the terms specified for each shipment.
Article 7 - Product Life warranty
In order to activate the "Product Life" warranty, you only need to register your product on our website within 3 months of your purchase : https://bodypack/pages/ subscribe-at-the-warranty.
If you do not activate Product Life, the product will only be guaranteed for 2 years, subject to the conditions defined here. In our policy of lifetime warranty we favor the replacement or repair of the product. If this is not possible, a refund will be made.
We will apply a refund in relation to the life cycles (details here) of your product according to our rule of antiquity:
Up to 3 years - 100%
3 years to 5 years - 80% of the purchase price refunded
5 years to 7 years - 70% of the purchase price refunded
7 years to 10 years - 60% of the purchase price refunded
10 years to 15 years - 50% of the purchase price paid
15 years to 17 years - 40% of the purchase price paid
17 years to 20 years - 30% of the purchase price refunded
